Agreement to these terms
These Terms and Conditions apply to every dumpster rental, junk removal job, delivery, and other service provided by Dumpster Rental Las Cruces (“we,” “us,” or “our”), and to your use of our website. By booking a service, accepting delivery, or using the website, you (“customer” or “you”) agree to these terms.
How we collect and use your information is covered in our Privacy Policy.
Quotes and pricing
Dumpster rentals are priced at a flat rate by container size. Unless your quote says otherwise, the flat rate includes:
- Delivery and pickup
- Disposal fees
- 7 rental days
- A weight allowance of 2 tons (15 yard), 3 tons (20 yard), or 4 tons (30 yard)
Current prices are listed on our pricing page. Prices can change, but the price in your confirmed quote is the price you pay, plus any extra charges listed in these terms. Junk removal, land clearing, track loader, and sand and gravel services are quoted per job.
Rental period and extra days
Your rental period starts on the delivery day and includes 7 calendar days. If you need the container longer, tell us when you book or call us during the rental. Extra days are billed at $15 per day. We will not pick up a container early unless you ask us to.
Weight limits and overage
Every load is weighed on certified scales at the disposal facility. Weight over your included allowance is billed at $75 per ton, based on the scale ticket. Heavy materials such as concrete, dirt, rock, roofing, and gravel fill a container’s weight allowance quickly, so tell us what you are loading and we will recommend the right size.
Loading the container
- Do not load material higher than the top edge of the container. We cannot legally haul an overfilled container on public roads
- If a container is overfilled, you will need to remove the extra material before pickup, or a return-trip fee may apply
- Spread weight evenly and place heavy items on the bottom
- Do not move the container, light fires in or near it, or let anyone climb or play inside it
Prohibited items
The following items may not be placed in the container, including but not limited to:
- Hazardous waste, chemicals, solvents, pesticides, and pool chemicals
- Liquids of any kind, including wet paint, motor oil, fuel, and antifreeze
- Asbestos and materials that may contain asbestos
- Medical waste and sharps
- Car and household batteries
- Propane tanks, gas cylinders, and anything pressurized
- Tires, unless approved in advance (a fee applies)
- Appliances containing refrigerant, unless approved in advance (a fee applies)
If prohibited items are found, we may remove them and charge you for handling and disposal, or refuse to haul the load until they are removed. You are responsible for any fines or cleanup costs caused by prohibited materials. Not sure about an item? Call us before you toss it.
Placement, access, and permits
- You must give us a clear, safe, and legal place to set the container, with enough room for our truck to deliver and pick up
- Tell us about gates, low wires, overhanging branches, soft ground, or HOA rules before delivery
- If the container must sit on a public street or sidewalk, you are responsible for any permit required by the City of Las Cruces or another local authority
- If we cannot deliver or pick up because the spot is blocked or unsafe, a trip fee may apply. We will tell you the amount when you book
Driveway and property protection
We place wooden boards under the container rails on every delivery to help protect your driveway. Our drivers set the container down slowly and check the placement before leaving.
If our driver damages your property during delivery or pickup, contact us within 48 hours with photos and we will make it right. We are not responsible for damage caused by loading, overfilling, pre-existing cracks or weak surfaces, or a placement location you chose after we warned you about a risk.
Scheduling, cancellations, and changes
Order by 2 PM and we can usually deliver the same day in most of the Las Cruces area. Delivery times are estimates and may change because of weather, traffic, or equipment issues.
You may reschedule or cancel at no charge if you tell us at least one business day before your delivery date. Cancellations made after that, or after our truck has left for your address, may be charged a trip fee.
Payment
Payment for the flat rate is due when you book or at delivery, as stated in your quote. Extra days, overweight charges, and any other fees are billed after pickup, once the scale ticket is received. Unpaid balances may be sent to collections, and you agree to pay reasonable collection costs.
Your responsibility for the container
From delivery until pickup, the container is in your care. You agree to use it only for lawful disposal of permitted materials, and you are responsible for loss of or damage to the container beyond normal wear, and for injuries or damage caused by misuse of it.
Limitation of liability
To the fullest extent allowed by law, our total liability for any claim related to a service is limited to the amount you paid for that service. We are not liable for indirect, incidental, or consequential damages, such as project delays or lost income. Nothing in these terms limits liability that cannot be limited under New Mexico law.
Indemnification
You agree to hold harmless and indemnify us from claims, fines, and costs caused by your breach of these terms, prohibited materials you placed in the container, or placement you directed on property you do not own or control.
Use of this website
We work to keep the information on this website accurate, including prices, sizes, and service areas, but it may occasionally contain errors or be out of date. Your confirmed quote controls. Website content, photos, and logos belong to us and may not be copied without permission.

Changes to these terms
We may update these terms from time to time. The version posted on this page when you book is the version that applies to your rental.
